Permission and Liability Declaration for Voice Cloning

By accepting and checking this authorization, you declare and warrant, under oath and your sole responsibility, and in full compliance with the law, that you possess the prior, free, conscious, express, informed, and voluntary consent of each person whose voice will be cloned using the Dubular platform. This authorization includes the development, storage, and use of the generated voice model, as well as the production and use of synchronized audios derived from it.

Required Evidence

Dubular may request at any time the submission of documentary or recorded proof of such authorization. Minimum acceptable forms of evidence:

  • A signed document (physical or digital) containing full name, identification, purpose, and signature
  • An audio recording in which the voice owner clearly and verifiably states their consent
  • A verifiable email sent from an account clearly attributable to the voice owner
  • A public and verifiable authorization issued through an official medium

Dubular reserves the right to request additional evidence and to assess the sufficiency of any proof provided.

Deadline for Submitting Proof

It is established that, in the event that Dubular requires it, the user is obligated to submit the requested proof within a maximum term of seven (7) calendar days, counted from the day following the date of notification of the requirement. Failure or insufficiency in the submission of proof will authorize Dubular to proceed with the immediate suspension of cloning, disabling access to the model, blocking related functions, and/or deactivating the user's account, without prejudice to other legal actions that may apply. The user expressly and directly grants authorization to be notified via the email provided at the time of account creation on Dubular.

Retention and Preservation

Original audios and cloned models may be maintained on the Dubular platform until the content owner, their legal representative, and/or the holder of the personal data involved requests their deletion, the account holder performs an express deletion, or the account is closed, all in accordance with Dubular's Privacy Policy. Likewise, Dubular will retain forensic records, such as hashes, metadata, generation and export logs, as well as consent records, in order to ensure traceability, auditing, and compliance with applicable regulations on personal data protection and intellectual property.

Measures in Case of Claims or Abuse

In the event of a duly substantiated claim by a third party or upon request from a competent governmental or judicial authority, Dubular may adopt the necessary measures for the investigation and handling of the case, including, but not limited to:

  • Immediately suspend access to and use of the model
  • Block audio downloads or exports
  • Request additional proof
  • Delete the voice cloning model.
  • Suppress all related personal data contained in the inputs or outputs.

Dubular commits to cooperate fully with competent authorities and enforcement agents, in strict compliance with the provisions of the law, facilitating the information and documentation required for the investigation and resolution of any case that may arise.

Indemnification and Liability

The user agrees to indemnify and hold Dubular harmless from any claims, penalties, fines, legal costs, and damages arising from the unauthorized use of third-party voices. This indemnification does not exempt Dubular from its legal obligations before authorities, nor does it limit the Company's right to take precautionary measures regarding the account or related content.

Minors and Persons with Limited Legal Capacity

Voice cloning of minors or persons with limited legal capacity is prohibited without verifiable consent from their legal representatives, guardians, and custodians. Any cloning of minors' voices detected without proper authorization will be immediately deleted, and the associated account may be disabled.

Effects of Revocation by the Voice Owner

If the voice owner requests deletion of the model or revokes their authorization, Dubular will process the request and proceed to delete or technically block the model within the operational and technical limits possible. The user acknowledges that, in some cases, full technical removal may be subject to technical constraints; in such cases, Dubular will adopt reasonable and documented compensatory measures.

Record Retention and Auditing

Dubular will retain records of consents, evidence, and actions taken for as long as legal obligations remain or to address claims and audits. These records include timestamps, IP addresses, account identifiers, and file hashes.
